Michigan Senate approves bill requiring opportunity to say Pledge of Allegiance in public schools

LANSING, Mich. -

The Michigan Legislature has passed legislation requiring every state public school classroom to have a U.S. flag and schools provide an opportunity for students to recite the Pledge of Allegiance.

The Senate on Thursday approved the measure related to reciting the pledge that was passed last week by the House. That bill and the previously passed flag legislation go to Gov. Rick Snyder for his signature.

Many students already recite the pledge but there is no required opportunity to do so. The bill specifies no student would be compelled to say it.

Some lawmakers have been concerned that cash-strapped schools can't afford the flags and the proposal thwarts local control.

The House Fiscal Agency says Michigan joins 43 states requiring public schools to offer a recitation of the pledge.

14-year-old boy shot outside Detroit gas station

DETROIT -

Detroit police have released pictures of a group of people they want to question in the fatal shooting of a 14-year-old boy on Wednesday night.

Police said the teen was inside a gas station in the 2400 block of Grand Boulevard when the group walked in and announced a robbery. The teen ran out but was fired at.

Anyone with information is asked to call the Detroit police's homicide unit at 313-596-2260 or Crime Stoppers at 800-SPEAKUP.

Employee killed during stabbing at Chrysler's Jefferson North Assembly plant in Detroit

DETROIT -

An employee at Chrysler's Jefferson North Assembly Plant was stabbed to death Thursday morning.

In a statement, Chrysler said the employee was killed during an altercation with another employee inside the plant on Conner Street. One of them died.

Production has been suspended for the day and workers sent home.

Flint Police say boy shot in foot by bullet meant for dog that was chasing him

FLINT, Mich. -

Flint police say a boy being chased by a dog was shot in the foot by a man who fired at the animal, but missed.

MLive.com says the unidentified boy was walking from his home about 7:30 p.m. Wednesday, when a "large hairy dog" started chasing him and prompted him to yell for help.

The boy says an unidentified man arrived with a black handgun, fired one shot at the dog, missed and shot the boy in the right foot.

Police in the in the city about 60 miles northwest of Detroit say the boy was treated and released from a hospital after receiving stitches to his foot.

No further details were released.

Stabbing reported at Jefferson North Assembly plant in Detroit

The incident happened Thursday morning inside the plant on Conner Street.

Students find body near Northwestern High School in Detroit

DETROIT -

Students walking to Northwestern High School in Detroit Thursday morning stumbled upon a homicide.

Police said a man in his 30s was found with a gunshot wound to the stomach just after 7 a.m. on Lawton Street near West Grand Boulevard.

Police said the body may have dumped out of a car.

No other details on the victim's identity were immediately released.

Appeals court throws out lawsuit in Meijer cart accident, says crack in lot was obvious

FLINT, Mich. -

The Michigan appeals court says Meijer shoppers should have no trouble seeing a 12-foot crack in the parking lot.

The court has reversed the decision of a Genesee County judge and thrown out a lawsuit filed by a 42-year-old shopper in Flint. Deborah Hudspeth says she was pushing her cart through a Meijer parking lot in 2009 when the wheels caught a crack. The cart tipped over and so did Hudspeth, who suffered injuries.

The appeals court says an average person would be expected to recognize the risk of a cart hitting a big crack in a store parking lot. Hudspeth says it also was dark that day. In response, the court says that simply means a shopper should proceed cautiously.

Police say Battle Creek man, 34, fatally shot by friend during drinking game

BATTLE CREEK, Mich. -

Police say a Battle Creek man is dead and the friend who shot him while playing a drinking game with a loaded revolver has been arrested.

Battle Creek Police Detective. Lt. Austin Simons says 34-year-old Nicholas Ullrich died about 10 p.m. Wednesday from a single gunshot wound to the head.

Simons tells the Battle Creek Enquirer Ullrich was found at a home where he and 34-year-old resident Samuel Castanier were celebrating the birthday of a third man. Simons says the men were drinking and playing with a revolver loaded with a single cartridge.

Simons says the men believed they were safe by looking at the cylinder before pulling the trigger, but forgot the loaded chamber advances when the trigger is pulled.

Castanier remains in custody, facing open murder charges.

Police officials to discuss results of Detroit's 'Broken Windows' pilot crime-fighting program

DETROIT -

Chief Ralph Godbee and other police officials will discuss the results of a "Broken Windows" pilot program aimed at reducing crime in a northwest Detroit neighborhood.

The community safety meeting begins Thursday evening at the North Rosedale Park Community House.

The long-range strategy developed with the New York-based Manhattan Institute for Policy Research includes efforts to maintain order, reduce fear, cut crime and improve the quality of life of residents.

"Broken Windows" is a decades-old method of community policing.

The Manhattan Institute's George Kelling has been working with Detroit police on the crime prevention approach. Kelling is one of the authors of a 1982 magazine article spouting the benefits of saving neighborhoods by putting more officers on foot patrols and focusing on issues that might appear insignificant.

Senate panel takes on Blue Cross overhaul plan

LANSING, Mich. -

A Senate panel is expected to discuss legislation aimed at overhauling Blue Cross and Blue Shield of Michigan.
 
   The Senate Insurance Committee's Thursday morning meeting plans include continuing talks that started Wednesday about proposals for ending the nonprofit health insurer's tax-exempt status and aligning it with competitors.
 
   The bills introduced Wednesday are based on recommendations from Republican Gov. Rick Snyder. He wants to "level the playing field" for insurers and modernize the charitable trust that serves 4.4 million Michigan residents.
 
   Blue Cross wouldn't be sold or lose its nonprofit status. It would become an organization owned by its policyholders.
 
   The plan requires approval by the Legislature and Blue Cross' board of directors.
 
   Senate Majority Leader Randy Richardville says he has no timetable for the legislation he described as "very complicated."

Detroit Schools tentatively passes enrollment goal

DETROIT -

The Detroit Public Schools tentatively has surpassed anticipated fall enrollment.
 
   As of Tuesday, 51,674 students had attended classes in the district's 100 schools. The district's fiscal year budget is based on fall term enrollment of 49,852 students.
 
   The district says attendance was 90 percent Tuesday as 46,668 students made it to class.
 
   Detroit Schools has been pushing to increase enrollment and attendance in all of its schools.
 
   A new automated calling system which notifies families of a student's absence in even one class each day has logged more than 177,000 calls and 41 attendance agents are addressing truancy.
 
   About 66,000 students attended Detroit schools last fall. That number was down from 104,000 in 2007 and 168,000 in 2000.

The average tip could be reaching 25 percent

It's a question we all face - what's a reasonable tip for your waiter?

According to the New York Post, tips may be adding a bigger chunk of your bill. Waiters in Manhattan, N.Y. now want a 25 percent tip, and some New York City restaurants that print "suggested gratuities" even have 30 percent as an option, the paper reports.

A study by Cornell University consumer behavior professor Michael Lynn, who studied 9,000 credit card receipts from a Poughkeepsie, N.Y. restaurant, found that more than a third of diners left tips greater than 20 percent.

Wait staff rely on tips, since tipped employees may be paid less, as low as $2.15 per hour according to federal law, although state law sometimes sets these minimum wages higher. According to Michigan's Department of Licensing and Regulatory Affairs, tipped employees may be paid $2.65 per hour, provided they receive and report tips that when combined with their hourly rate equals or exceeds the minimum hourly wage rate of $7.40 per hour.

The phenomenon of "tip creep" has plagued restaurant-goers for generations. Since 1918, the acceptable tip rate increased from 10 percent of the bill to 20 percent.

Nowadays, 15 percent isn't an average tip - it's a way of registering displeasure with the service.

How much do you normally tip when out at a restaurant? Is 30 percent a reasonable tip for great service?

Washington Township wedding guests save woman when her heart stops beating

WASHINGTON TOWNSHIP, Mich. -

Linda and Gerald Gerald Modzelewski and Jelena Doty are being honored for saving a life.

Some call them heroes but Linda, Gerald's wife, considers these two her angels. Linda and her husband were attending a wedding in Washington Township in July when her heart stopped beating.

"I just collapsed. I don't remember hearing or seeing anything after that," Linda said.

She had stopped breathing. Her husband began CPR. He brought her back twice before she was gone again.

"Somebody told me, 'There's a nurse here. Let her in.' So, of course, I went to the nurse. She had more experience than I did," said Gerald.

Doty began CPR and so did another nurse. Together, they brought Linda back to life.

"I was just hoping I could do the best that I could and thank God that I had the people with me to help," Doty said. "I can't reiterate how important CPR is and that everyone should know CPR."

And she is not the only one.

"I want to cry. I'm just so happy to have her," Gerald said.

Jelena Doty A ceremony Wednesday night brought everyone back together and back to the day when Linda almost slipped away.

"I have a wonderful husband, family and friends and I still do. I'm just thankful to be here to continue a little longer," she said.

Former Wayne County official convicted in fraud case appears on Kilpatrick trial witness list

Former Wayne County official on Kilpatrick witness list

DETROIT -

Wilbourne Kelley His name is Wilbourne Kelley, and if you recognize it there is a reason.

Kelley and his wife are the only people to be convicted in the late Ed McNamara Wayne County administration. Kelley was sent to prison after refusing to snitch on his boss.

Now, with his life back on track, he is stunned to find his name on the witness list for former Detroit mayor Kwame Kilpatrick's federal trial.

Kelley's name pops up in the news when the history of Wayne County corruption is reported. But you wouldn't recognize him now. Today, Kelley is a maintenance supervisor at the renovated Double Tree hotel in Detroit. He works quietly with a smile on his face. For the life of him, he cannot understand why, at 76 years old, he and his wife's name are still dragged through the mud years after doing his time.

"I served that time for that, so I know ... right now, my wife and I are just trying to get on with our lives," Kelley said. "I'm just trying to live out the rest of my days in an honorable manner."

Kelley says there is so much more to him than the footnote of being the only person convicted in McNamara's administration. He was a standout at West Point. A Vietnam War hero. He fought the Tet Offensive in 1968 where he took a bullet to the leg. His collection of medals includes a bronze star, a Legion of Merit and a Purple Heart.

"I came back highly-decorated from Vietnam. So, when I continue to see them say 'ex felon' it demeans all that I've done with my life," he said.

Ed McNamara Kelley did not plead guilty to charges that he took bribes for contracts while working for Wayne County because he doesn't think he is. A jury found him guilty.

"He befriended me and my wife. Had us come meet his family and all that sort of thing. The next thing I know he was offering to do things for us," Kelley said.

Kelley says he thought it was just a good friend helping him with free work on his house, but then he came looking for a payback: Contract for work at the airport.

"And then, subsequently, about five or six months later he had the contractor who made the repairs submit a bid to me," Kelly said.

He accepted the jury's decision. He served three years in prison. He says he would have only gotten probation if he gave up information on his boss, then Wayne County executive McNamara.

"It wasn't anything that I saw with my own eyes," Kelley said.

Kelley said it wasn't a refusal to snitch, as was reported, but that he did not have any personal proof of wrongdoing.

"I didn't really have anything to give them and, you know, my lawyer says, 'Oh, you know we have all kinds of good stuff,' but you know that wasn't the case at all," he said.

Today, Kelley and his wife go to church services on a regular basis and help less fortunate people in the congregation.

"When I came back (from prison) I said, 'Well, down in prison you really are forced to get back in touch with your religious roots,'" he said.

Kelley knows he can't stop people from using his name only in connection with the old Wayne County investigation. He just wishes they would. Now, there is a new twist that is sure to keep the negative footnote at the forefront. Kelley just found out he is on the witness list for Kilpatrick's trial.

"I have no idea why I'm on that list because I have no knowledge of what they were doing in the mayor's office or the city of Detroit," he said.

Wilbourne Kelley and Bernard Kilpatrick It turns out Kelley was not the only guy investigated in the McNamara administration. Bernard Kilpatrick, Kwame's father, held a top post, too. He was investigated but never charged. Kelley thinks he may be called to give up old secrets. However, he says, he has no personal knowledge of corruption.

"I was over on the other side with the public service. So, we never interacted at all on any of that kind of business," Kelley said.

As for Kwame Kilpatrick, Kelley knew him from the time he was a teenager. However, he only had one questionable interaction with the former Detroit mayor. Kelley says he refused Kwame Kilpatrick's endorsement of Bobby Ferguson for school renovation work.

"I did talk to Kwame ... that was the end of that," he said.

Metro Detroit airport authority names chief exec

ROMULUS, Mich. -

The board that runs Detroit Metropolitan and Willow Run airports has given its interim chief executive the job on a long-term basis.

The Wayne County Airport Authority on Wednesday appointed Thomas Naughton to a job that Turkia Mullen held until her removal in a scandal over her $200,000 severance payment from a previous county job.

Airport board chairwoman Mary Zuckerman says Naughton has shown strong administrative skills in his 11 months on the job.

The board dismissed Mullin last October after only two months on the job, saying she violated terms of her employment.

Mullen later repaid $135,900, the after-tax amount of her severance.

Michigan man guilty of sexually assaulting, murdering 3-month-old daughter at northern Indian reservation

GRAND RAPIDS, Mich. -

A federal jury has found a man guilty of sexually assaulting and murdering his 3-month-old daughter on a northern Michigan Indian reservation.

The U.S. District Court jury in Grand Rapids reached the verdict Wednesday against Steven Deuman.

The first-degree murder conviction carries a mandatory penalty of life in prison without parole.

The girl died Aug. 12, 2011, on the Grand Traverse Band of Ottawa and Chippewa Indian Reservation, northwest of Traverse City.

An autopsy indicated the baby was asphyxiated.

Defense lawyer Richard Stroba says the death was accidental, and Deuman wouldn't harm his children.

Federal authorities investigated the death because it occurred on tribal land.

Deuman and the baby's mother lived on the reservation.

During the trial, witnesses testified that Deuman sexually abused them when they were children.

Warren high school football star Shane Morris may be sidelined for season

WARREN, Mich. -

Warren De La Salle football practice The senior season of Warren De La Salle quarterback Shane Morris may be over because of an illness.

Morris, who has committed to play at the University of Michigan, has been diagnosed with mononucleosis. Morris is considered one of the top three high school quarterbacks in the country.

De La Salle Collegiate assistant principal and athletic director Brian Kelly said the illness has forced Morris off the field.

"He's like any other kid with mono, he's not feeling well, he's fatigued, he doesn't have the strength or energy that he would normally have," Kelly said.

Morris was diagnosed with mono last week, but there were no concerns about his spleen, so he played in Saturday's game against Birmingham Brother Rice.

His performance was not top-notch.

"At about half-time, he was in bad shape, really lethargic," Kelly said.

Brian Kelly said there is concern the mono could keep Morris from playing all season, putting a premature end to his high school football career.

"It is a big deal. He's a great kid, he handles things even in al the hoopla that's surrounding him. He handles it extremely well. He's an outstanding teammate, great classmate and everyone is pulling for him," Kelly said.

Shane Morris is currently under doctor's orders to rest.

There remains a hope that he will recover and be able to return to the football field before the season ends.

Arson suspected in string of house fires on Detroit's east side

House fires erupt on Detroit's east side

DETROIT -

NightCam fires Detroit Firefighters have been battling a dozen fires that have popped up on Detroit's east side overnight.

On Tuesday night, the fires burned several homes near Lamont and Nancy streets, near McNichols Road and Conant Street. Three more homes were also burning nearby on Hasse Street. All the homes are abandoned, but they are near occupied homes.

On Wednesday, fires erupted on Van Dyke and Sheridan.

Investigators believe a serial arsonist could be at work. They tell Local 4 the arsonist or arsonists are using jet fuel which makes the fires burn quicker and hotter.

Africa Chippings woke up to the fire Wednesday morning.

"The heat was hot ... as soon as we hit the door you could feel the heat," Chippings said.

The abandoned home next to Chippings' was up in flames, and the fire quickly was spreading.

"It was popping like something going off inside the house," Chippings said.

Detroit firefighters took a defensive approach to the fire to ensure their own safety.

Investigators believe the arsons are connected. Over the past two days where have been 30 arsons in the city. Fourteen of those have been on the west side and 16 on the east side. Sources working closely to the investigation say whoever is setting the homes on fire has a message which is maybe meant for Detroit city officials.

Court: Michigan law doesn't stop employers from firing people with medical marijuana cards

BATTLE CREEK, Mich. -

A federal appeals court says Michigan law doesn't stop employers from firing people who use medical marijuana.

The court on Wednesday upheld a decision by a federal judge in Grand Rapids, who said Wal-Mart Stores could fire an employee who tested positive for marijuana.

Joseph Casias was an inventory-control manager at a Walmart in Battle Creek until he tested positive for marijuana in 2009.

He has a Michigan medical-marijuana card and uses pot to alleviate symptoms of an inoperable brain tumor and cancer.

Wal-Mart says marijuana use conflicts with its safety policy in stores.

Detroit neighborhood fearful, alert after woman's sexual assault

DETROIT -

Woman assaulted walking to Detroit bus stop Detroit police say an 18-year-old woman was sexually assaulted Monday morning while she walked to a bus stop.

Police said the woman was grabbed from behind by a man in the 20500 block of McCormick and forced behind a vacant house.

No description of her attacker was given. The victim was recovering at a hospital.

"This scares me," said Kayla Jennings, who frequents the bust stop. "Thought this road was safe. Pretty major road."

Jennings is watching her back now more than ever when walking to the bus stop.

"I think I should probably get pepper spray or something to protect myself," said Jennings.

Some women in the area are canceling their daily walks because they fear a rapist is on the loose.

Woman assaulted walking to Detroit bus stop Neighbors have been sending the victim get-well wishes. The neighborhood watch group is increasing patrols. They hope their presence will put women at peace once again.

"All of them are fearful for their life. It's dark over here," said Darryl Thompson, of the neighborhood watch group.

Michigan hiker injured after fall in New Hampshire wilderness rescued

FRANCONIA, N.H. -

New Hampshire Fish and Game officials say rescue crews who endured high winds and torrential rain to rescue an injured Michigan hiker in the White Mountains likely saved his life.
Fifty-nine-year-old Edward Bacon of Northville, Mich., was on the third day of a five-day solo hike around Franconia Notch when he fell Tuesday afternoon and seriously injured his hip.

Bacon crawled to an area where he was able to get brief cell phone reception and called both 911 and the Appalachian Mountain Club (AMC) Lodge in Pinkham Notch.

He was equipped with backpacking gear, although his tent had blown away in the fierce winds.

Bacon was able to climb into his sleeping bag to stay warm, as he was becoming hypothermic from the rain and high winds while awaiting rescuers.

AMC initially sent out a rescuer from to try to find Bacon, but high winds forced that individual to turn back

A second team reached Bacon around 6:20 p.m., followed soon after by New Hampshire Fish and Game officers and volunteers.

Facing wind gusts of 80 mph and swollen rivers and streams, rescuers carried the injured man out of the wilderness.

Bacon was secured on a litter for his trip down the mountain.

The rescue team didn't reach the trailhead until after 3 a.m. Wednesday where Bacon was then transported by ambulance to the hospital.

"I want to commend the Herculean effort of all the participating search teams working through the night in very difficult conditions and rugged terrain to carry this man to safety.  Most likely, they saved his life," said Fish and Game Lt. James Kneeland.

Kneeland said that conditions were changing fast in New Hampshire's mountains. 

Hikers are advised to carry lights, extra clothing and appropriate gear for a variety of weather conditions, especially at higher altitudes.

Car crash on I-75, Dixie Highway leaves 2 in hospital

LINCOLN PARK, Mich. -

State Police say a serious traffic accident happened Wednesday morning on northbound I-75 and Dixie Highway in the City of Lincoln Park.

Witnesses told police a silver Nissan, travelling north at a very high rate of speed, rear ended a Ford Mustang.

Both drivers were transported to local hospitals.

The driver of the Nissan was listed in critical condition and the other driver is listed in stable condition. 

Police say seatbelts were used by both drivers.

Troopers are continuing to investigate the accident and are still trying to identify the driver of the Nissan.

Police say alcohol is a factor in the crash.

Kilpatrick corruption trial jury called 'diverse'

DETROIT -

12 jurors and 6 alternates have been selected to participate in the Kwame Kilpatrick federal corruption trial.

The jury consists of 4 white females, 2 white males, 1 Hispanic female, 4 African American females and 1 African-American male.

The alternates include 2 African American females, 1 African American male, 2 white males and a white female.

It is a very diverse jury pool- exactly 50% minority- in a case that has greatly emphasized race.

The exercise of peremptory challenges began at 9 am this morning. 64 potential jurors gathered in federal Judge Nancy Edmunds' courtroom to see if they had been selected to sit on the final jury.

Right off the bat, Judge Edmunds asked if any of the potential jurors had come up against anything that might make it difficult for them to sit on the jury. 4 jurors were excused immediately.

There were then 6 rounds of peremptory challenges- the right in jury selection for the defense and prosecution to reject a certain number of potential jurors who appear to have an unfavorable bias. Government and defense counsel were asked to submit their strikes for jurors they wanted to excuse. Each of the 6 rounds included 4 strikes for the defense and 2 for the government. These were submitted in writing to the judge who then read out the numbers of the jurors excused.

In each of the 6 rounds, there were Batson challenges- objections to peremptory challenges on the grounds the other party used it to exclude a potential juror on the basis of race- by the defense to some of the government strikes.

The defense kept reiterating that they felt the government was excusing a much greater percentage of minority jurors. The government argued that their choices had nothing to do with the race of the juror but with the juror's perceived attitudes towards race. In every instance except one, Judge Edmunds denied challenge saying that the government made its point that jurors were not being excused opn the basis of race.

In the 5th round, Judge Edmunds did reserve judgment on one of the jurors. After reviewing the potential juror's questionnaire, however, she ultimately decided to deny the defense's Batson challenge.

After the 6th round, the defense and prosecution used their final additional strikes to whittle the pool to the final 12 jurors and 6 alternates.

After the finale 18 were selected, Judge Edmunds congratulated them and had them sworn in.

Opening statements in the trial begin Friday morning.

Jury set in Kilpatrick corruption trial; opening remarks Friday

DETROIT -

After nearly two weeks, the jury has been selected for the corruption trial of former Detroit Mayor Kwame Kilpatrick.

Federal Judge Nancy Edmunds summoned more than 60 candidates to court this week.

The 12 jurors include four African-American women, one African-American man, one Hispanic woman, two white men and four white women.

Alternates include: two white men, one white woman, two African-American women and one African-American man.

They have been sworn in by Edmunds and will appear in court for opening statements on Friday morning.

The judge plans to hear arguments Thursday about moving the trial outside of Detroit, but that defense request likely will be denied.

Race has been a sensitive issue during jury selection. Critics say juries in Detroit federal court don't always reflect the racial makeup of the Detroit area.

Three of the four defendants — Kilpatrick, his father Bernard Kilpatrick and Bobby Ferguson — are black.

Opening statements heard in Bianca Jones murder case

DETROIT -

Opening statements were Wednesday in the trial of a Detroit father who is charged with murdering his 2-year-old daughter.

Bianca Jones hasn't been seen since Dec. 2, 2011, when her father, D'Andre Lane, said he was carjacked with her in the back seat.

Police found Lane's car a short time later, but the girl wasn't in it.

Lane is accused of beating Bianca to death with a stick with a towel wrapped in duct tape, and disposing of her body. Lane told officers during questioning that he had spanked the child for wetting herself. However, her body has still not been found.

Defense attorney Terry Johnson has said prosecutors have no evidence against Lane, and their "case is based on the argument that he spanked her."

Lane is charged with murder and child abuse.

Banika Jones, Bianca's mother, testified that when she had found out she was pregnant, she and Lane planned to get an abortion. But they didn't go through with it. Banika Jones said she never had any concerns about Lane taking care of their daughter and that he had even volunteered to watch her instead of having her go to daycare. The mother said her daughter spend lots of time with her father, but hadn't ever spent the night until Nov. 28, 2011 -- that's when she dropped the girl off for a visit that would last a couple of days.

"I would do anything to have my daughter home," Banika Jones said.

More help needed for Asian bone marrow transplant registry

Many Americans are in dire need of a bone marrow transplant, but it's especially hard for minorities to find a match.

Jeremy Kong was just like any other 2-year-old boy until doctors told his parents, Alice and Anthony, that he had a rare form of leukemia.

They also said he needed a bone marrow transplant by December.

"I just love him and adore him. It's just hard to kind of see him and not know what's going to happen to him," Alice Kong said.

Ruby Law with the Asian American Donor Program is fighting for the Kong family. Law herself lost a friend to leukemia and wants more people to help by signing up for the donor registry.

According to the AADP, there are 9 million people on the national bone marrow registry, only 7 percent are Asian. Jeremy is Chinese, which means he only has a 1 percent chance of finding a match.

The Kongs are expecting their second child and are hoping Jeremy will be there to welcome his new little brother or sister.
